Largest Eminent Domain Verdict in Arizona History
On January 25, after 10 days of trial, a jury awarded Toll Brothers AZ Construction Co. (an affiliate of Toll Brothers, Inc.) nearly $82 million against the City of Scottsdale for the condemnation of its property. Jeff Gross and Jennifer Ratcliff, in association with Dale Zeitlin, represented Toll Brothers during the trial. Glen Hallman, Mark Dangerfield and Mark Fuller played a large part during the 4 year litigation.
The eminent domain action involved the taking of 383 acres of prime residential land in North Scottsdale for the McDowell Sonoran Preserve. The City's position at trial was that just compensation due to Toll Brothers was $33.8 million, while Toll Brothers requested a jury award of $107 million. With interest, the total amount due Toll Brothers likely will exceed $90 million. The case resulted in the largest eminent domain verdict in Arizona history.
